What method of calculating the own funds requirement should be used when a group consists of both 95(1) and 96(1) investments firm and no credit institutions?

Article 98(1) and 98(2) of CRR set out provisions for calculating the own funds requirement for Groups that either includes 95(1) investment firms or 96(1) investment firms (and no credit institutions), but not both types of investment firms.

Please note that as part of adjustments to the Single Rulebook Q&A process, agreed by the EBA and the European Commission, it has been decided to reject outstanding questions submitted before 1 January 2020, when the Q&A process was updated as part of the last ESAs Review. In particular, the question that you have submitted has now regrettably been rejected and will not be addressed.
