Articles 125(2) and 126(2) CRR permit the EBA to publish loss rates for third countries where local competent authorities do not provide such data, provided statistically representative information is available. Switzerland is recognized as having an equivalent supervisory regime under Article 107(4) CRR, but no official loss rates for exposures secured by residential and commercial property exist. Without EBA data, institutions cannot apply preferential risk weights for Swiss exposures, creating regulatory inconsistency and competitive disadvantages for EU and EEA institutions with cross-border operations.
