Recital 71 suggests that Article 54 applies to non-banks. Also recital 14 and Article 7 of 2009/110/EC seems to suggest that banks are regulated elsewhere (CRR/CRD).

This question has been rejected because the issue it deals with is already explained or addressed in Recital 71, Article 54 and Article 58(1) of Regulation (EU) 2023/1114 of the European Parliament and of the Council of 31 May 2023 on markets in crypto-assets, to read in conjunction with Regulation (EU) No 575/2013 as amended by Regulation (EU) 2019/876 (Capital Requirements Regulation or CRR2) and Directive 2013/36/EU as amended by Directive (EU) 2019/878 (Capital Requirements Directive or CRD5) as well as associated delegated and implementing acts, and guidelines and recommendations, adopted under these legislative acts.
