CEBS organises a public roundtable to foster convergence in the application of Pillar 3 requirements and thereby enhancing comparability of related disclosures
The Committee of European Banking Supervisors (CEBS) organises a public roundtable on 9 December at the CEBS premises in London from 10.00 to 13.00 to foster convergence in the application of Pillar 3 requirements and thereby enhancing comparability of related disclosures. This objective is to be reached by providing a platform for the dialogue between banks and users of Pillar 3 disclosures in order to deepen the insight into the utility of and the problems related to Pillar 3 disclosures. To stimulate the discussions we envisaged to have presentations both from users and preparers before engaging in a discussion.

This event is aimed to follow-up on the findings made in the context of the assessment of the Pillar 3 disclosures of 25 large banks published in June 2009. CEBS noted in that context that efforts have been made to provide market participants with information allowing a better understanding of banks' risk profile and capital adequacy but that the heterogeneity in terms of both presentation and content may reduce the usefulness of the information for users. CEBS has since then engaged in discussions with users of Pillar 3 disclosures and organises this public roundtable to provide a forum for the discussion of users’ needs against the difficulties encountered preparers.

To set the framework for the discussion CEBS has directly invited representatives of both group of users – including credit rating agencies and bank analysts - and of preparers to present their views at the roundtable. The agenda provides further information on the organisation of this event and participating speakers .

CEBS deems it useful to open the event to all interested parties to reach the widest possible audience. A number of places at the roundtable are still available. Interested parties should register by 4 December at the latest. Priority will be given to Pillar 3 users and preparers.

CEBS organises a workshop on internal governance

The topic of internal governance has been receiving recently more and more attention from various policy making bodies around the world. The first wave of this focused attention was largely targeted to the remuneration (incl. executive pay) in the financial sector, however, recently the broader aspect of internal governance is subject to heightened attention.

CEBS is making a survey on the implementation of how European banks have implemented CEBS principles for internal governance (CEBS Guidelines on Supervisory Review Process). The objective of the survey is to identify the major general issues and topics for the further detailed investigations. This analysis will serve as an input to updating CEBS guidelines on internal governance.

To facilitate the discussion we will send out to participants one week before the workshop takes place a summary of the issues raised in the survey and a first view on areas which need to be enhanced in the future.

Supervisors and industry will make presentations on their internal governance experiences in order to foster the discussion on the way forward with the CEBS principles on internal governance.

The workshop on internal governance will take place on Tuesday, 1 December 2009 from 9:30 am to 13:15 pm, in London, at CEBS’s premises.

Public hearing on CP29 for the extension of CEBS's supervisory disclosure framework
The Committee of European Banking Supervisors (CEBS) has launched a consultation on the extension of CEBS's Supervisory Disclosure Framework. The consultation is open to all interested parties, including supervised institutions and other market participants.

While the current supervisory disclosure framework covers only the legislative provisions, the supervisory application of the rules (e.g. the supervisory review process under Pillar 2) and the statistical data on the implementation of the Capital Requirements Directive, and disclosures on reporting (COREP/FINREP), CEBS has decided to develop the common framework further and to extend it to other areas of community legislation during the course of 2009. Based on current regulatory developments, CEBS has focused the extension of the framework on the following areas: Mergers and Acquisitions; Securitisation; Credit Risk Mitigation; National discretions; Pillar 2 and Pillar 3. 

This consultation paper (CP29) provides a brief explanation of each area of extension with accompanying draft template(s) for supervisory disclosures and draft guidance for their population.

CEBS submits its draft proposals for a public consultation which starts today and runs until 16 October 2009. Comments received will be published on CEBS’s website unless respondents request otherwise. Please send your comments to the following e-mail address: cp29@c-ebs.org.

CEBS organises a public hearing on liquidity buffers

Following the publication of the interim report on liquidity buffers and “survival” periods in March 2009, CEBS has launched a public consultation on its draft guidelines on the appropriate size and composition of liquidity buffers in order to enable credit institutions to withstand a liquidity stress for a period of at least one month without changing their business models. The guidelines are aimed primarily at banks’ internal risk management processes, although they may be helpful for supervisory review purposes as well.

CEBS's consultation paper (CP28) should be read as a follow-up to CEBS’s Recommendations on liquidity risk management, in particular to Recommendation 16.

Comments received will be published on CEBS’s website unless respondents explicitly request otherwise.

A public hearing will take place on Tuesday 22 September 2009 from 10.30 am to 12.30 pm at the CEBS’s premises in order to allow all interested parties to put forward their views on the consultation paper.

Public hearing on CEBS's implementation guidelines on hybrid capital instruments

In June 2009 the Committee of European Banking Supervisors (CEBS) published its consultation paper (CP 27) on its implementation guidelines on hybrid capital instruments. The consultation is open to all interested parties, including supervised institutions and other market participants.

Following CEBS’s proposal for a common EU definition of Tier I hybrids, published in April 2008, explicit rules for the treatment of hybrid capital instruments are now included in the amended Capital Requirements Directive (CRD).

This consultation paper responds to Article 63a (6) of the revised CRD that requires CEBS to “elaborate guidelines for the convergence of supervisory practices with regard to the instruments referred to in Article 63a (1) and in Article 57(a) and monitor their application”. In addition, the draft guidelines aim to complement the new CRD provisions, in particular Articles 63a and 66 (1a) where additional guidance appears necessary or appropriate. Thus, the draft guidelines presented in this consultation paper cover the topics of permanence, flexibility of payments, loss absorbency, limits and hybrid instruments issued through an SPV.

Public hearing on CEBS's draft implementation guidelines on the revised large exposures regime

CEBS has published in June 2009 a consultation paper (CP26) on draft implementation guidelines for three aspects of the revised large exposures regime. The consultation is opened to all interested parties, including supervised institutions and other market participants.

Following CEBS's second advice delivered to the European Commission in April 2008, a revised large exposures regime is now included in an amendment to the Capital Requirements Directive (CRD). The amended provisions need to be transposed into Member States' national law by 31 October 2010 and will then be applied from 31 December 2010.

The intent of CEBS’s paper is to move forward with respect to the GL10 paper of April 2006, which provided only limited guidance on insurance contracts and Other Risk Transfer Mechanisms (ORTM) for transferring operational risk.

CEBS and CEIOPS organise a public hearing on the review of Financial Conglomerates Directive
The Committee of European Banking Supervisors (CEBS) and the Committee of European Insurance and Occupational Pensions (CEIOPS) - through the Joint Committee on Financial Conglomerates (JCFC) published the formal consultation on its proposed advice to the European Commission (EC) on its review of the Financial Conglomerates Directive(FCD).

CEBS and CEIOPS, through the JCFC, will hold a joint public hearing on 8 July 2009 from 9:30–12:00 CET at CEIOPS premises in Frankfurt.
 
In order to allow for a focused consultation, the JCFC has developed some concrete questions on which it would be very keen to hear market participants’ views. In areas where the JCFC is proposing Level 3 guidance, input is welcome for suggestions for developing such guidance.

CEBS organises a public hearing on transparency

The Committee of European Banking Supervisors CEBS organises a public hearing in London on 28 May 2009 (from 10:00 to 12:30) to discuss the findings of its follow-up work assessing banks’ transparency. CEBS will i) present the findings of the analysis of the disclosures provided in banks’ 2008 audited annual reports and under Pillar 3 and ii) invite the industry’s views on the preliminary conclusions and on any related measures.

CEBS organises a public hearing on custodian banks

Following the delivery of the report on custodian banks to the ECOFIN, CEBS has committed to undertake further work to establish the materiality of custodian banks internalising settlement activities or carrying out Central Counterparty (CCP)-like activities. The report identified certain gaps with regards to these activities in the current applicable banking regulations, in comparison to the ESCB-CESR draft Recommendations.

In order to gather evidence about the extent to which such activities are performed, CEBS published a questionnaire which will help assess the materiality of this market practice. The questionnaire was published for a public consultation from 2 February until 4 March 2009. In parallel CEBS has also asked its members and observers to report on their assessment of such practices in a separate questionnaire. CEBS expects to deliver its results by early Q2 2009.

These principles address key aspects of a well functioning remuneration policy and thus support the sound operations of banking institutions. The consultation will last for one month and will end on Friday, the 3rd April 2009. The shortened consultation period is caused by external deadlines.
